The Failure of the 28-Clause Peace Proposal for Ukraine: Why Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the tension caused by the presentation of a new 28-point plan for resolving the conflict appeared – briefly – to have been contained. A senior US official spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its countermove: an extensive attack of rocket attacks on Kyiv.

The Cycle of Diplomacy and Destruction

The chain of opposing developments captured the harsh reality of the recent timeframe. By day, negotiation efforts are waged: positive announcements are issued from various governments. Significant resources is devoted on restraining particular approaches. By night, Moscow brutally reminds the world that, for them, war remains the primary tool for achieving "settlement".

Nighttime Reality

As the offensive unfolded into the early hours of Tuesday, the present situation of Ukraine's defenselessness was revealed. Ukraine is able to track rocket firings from Russian territory, a capacity afforded by current data. From witness perspectives, military aircraft that had been deployed to counter approaching cruise missiles flew past – advanced fighter aircraft provided to Ukraine by NATO members.

Moments later, Kyiv's air-defence systems engaged: several firings fired to intercept a incoming threat. This was a advanced protection mechanism at work, most likely provided by partner states. Every launch shakes the surroundings, causing tremors. The moment of terror quickly gives way to resigned acknowledgment: maybe the approaching threat won't strike its target this time, protecting urban areas from ruin and another blackout.

Persistent Threats

Soon after, a automatic firearm fired at a drone somewhere nearby, part of a defensive team – most likely imported technology. Unfortunately, the shots failed to hit the opposing UAV – it maintained course toward its objective.

Intermittently, this continued until dawn. Kyiv greeted the morning news: multiple fatalities, devastation and heating outages in numerous residences as a result of the night's assault. As typically, everyone still went about their day – experiencing conflict. But those full day illustrated Ukraine's essential dependence on external assistance – a need that neighboring countries are evidently unprepared to replace in the short term.

Failed Diplomacy

The comprehensive proposal from Washington generated strong feelings, debate and profound anxiety – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after earlier high-level meetings and international summits.

Every new initiative from US leadership unfolds according to the consistent cycle: a negotiation push against Ukraine, which Kyiv, with allied governments, succeeds in resisting. They contain the crisis but never actually win the battle. This pattern will, certainly, persist.

Political Considerations

It is tempting to accuse particular leaders of consistently pushing Moscow's conditions. But that does not seem to be the whole story. Washington operates on a principle understood by seasoned negotiators: you cannot secure via talks what you have lost on the battlefield. The US administration presumes that it is impossible to force Russia to relinquish the territory that it already controls in Ukraine's south or east.

The challenge is that while acknowledging this situation, American administration does minimal to deter Moscow, through statements or actions, from thinking that the status quo will not shift further in its favour in the near future.

Conflicting Perspectives

Therefore, Russian leadership is certain that time is on his side – that Ukraine and its allies are coming close to fatigue. Their motivation to accept conditions that does not give them the greatest potential benefit is close to zero. There may be many attempts to stop fighting, but they will continue as long as Russia's leader remains supremely confident in the result.

On the contrary, Ukraine's government believes that Ukraine can still persist, gradually sacrificing civilians and areas but averting a complete military breakdown until situations evolve in its advantage.

Existing Situation

Objectively, there are no actual prerequisites for a ceasefire. Now, personal considerations are coming into play: political desires to broker a ceasefire and achieve global acclaim, and Kyiv's dual difficulties – on one hand, not to distance important partners, and on the other, to unite the population around the flag against any proposal Kyiv finds unsuitable, so that their focus does not move to homefront challenges. And although their task will now be much harder after latest incidents, it remains very improbable that this will modify their basic position.

These two forces are influencing discussions.

Summary and Prospects

It took a just a single week to kill the proposed articles of the latest plan. Forceful and unpredictable management of the matter by American leadership, resistance by Ukraine and the remaining European nations, along with pacifying measures of negotiators, and finally, latest revelations, all achieved their purpose.

While new initiatives based on established approaches are imminent, Kyiv, London and other European capitals should draw one fundamental conclusion: Ukraine and Europe will only be able to resist diplomatic offensives from Washington that are founded on Moscow's terms and reflect particular unwillingness to alter the situation, if they remain united and strengthen their defence capabilities at a significantly accelerated rate. If they do, neither political nor armed coercion will be able to break them. In the meantime, Ukraine's capability to repel nightly air assaults will, for the predictable period, largely rely on continued Western support.
